Common Questions About Mediation

What is a MIAM?

MIAM stands for Mediation Information and Assessment Meeting. This is the initial step in the mediation process where a trained Mediator will explain the mediation procedure and its benefits to you and your spouse or the other party to your dispute.

Not all cases are suitable for mediation, for example, if:

  • One party is bankrupt
  • There is evidence of domestic abuse
  • There are child protection concerns
  • You and the other party have attended a MIAM in the last four months
  • One party is at significant risk of harm or hardship

While mediation is not mandatory, attending a MIAM is required (except in the above situations) if you wish to initiate Court proceedings.

You can attend a MIAM alone or with the other party. During the session, the Mediator will gather information to determine if mediation is suitable. If mediation is not appropriate or you choose not to proceed, you will receive a form confirming your attendance at a MIAM, which is required for Court proceedings.

What are the advantages of mediation?

Mediation offers numerous benefits, including:

  • Parties can express their concerns and needs in the presence of a qualified Family Mediator
  • The Mediator is impartial and supports both parties equally
  • The Mediator assists both parties, unlike a Solicitor who represents only one party

  • Mediation is voluntary; no one can force you to agree to any proposals

Is what is agreed during mediation legally enforceable?

Mediation is voluntary; however, if both parties reach an agreement, our Solicitors can draft documentation to be submitted and approved by the Court, making the agreement legally binding.
