What does it mean to exchange contracts?
The seller and the buyer’s Solicitors will each prepare contracts for their client to sign. Once all the title and property searches have been completed and questions from both parties are answered, the Solicitors will ‘exchange’ contracts for signing. Upon exchanging contracts, both you and the other party are legally obligated to complete the transaction. Failure to do so could result in compensation being sought by the wronged party.
How long will my property transaction take?
Typically, it takes around 12 weeks to complete the sale or purchase of a residential property. However, if you are in a chain or the transaction is particularly complex, it may take longer. External factors such as the Coronavirus pandemic can also cause delays due to staff shortages in banks and local authorities.
Should I invest in property searches?
We highly recommend that you have the following property searches done:
- Water and drainage
- Local authority
- Environmental search
Depending on the location of your new property, we may also suggest a:
- Chancel repair liability search
- HS2 search
- Flood risk report
Property searches can save you from the disappointment, frustration, and financial loss associated with discovering problems with your new home. Most issues can be identified through title and general property searches. We also recommend investing in a HomeBuyers Report (at minimum) to check for any property defects.
What does it mean if there are restrictive covenants listed on the title of the property I plan to buy?
A restrictive covenant imposes limitations on how you can use your land to preserve the value and enjoyment of adjoining land. For example, the title might include a covenant stating that you cannot keep poultry on your land or operate a business from the property.
Restrictive covenants are often found on the titles of properties located in new-build estates. These covenants ensure that certain standards are maintained and that the value of neighbouring properties is not diminished due to the actions of one homeowner.
Restrictive covenants run with the land, meaning they bind any future owners. If you are selling a property with restrictive covenants, they will apply to the new owner as well.
