What is a Lasting Power of Attorney?
An LPA allows you (the Donor) to appoint someone you trust (the Attorney) to manage your affairs if you become mentally incapacitated.
There are two main types of LPAs:
- Financial Affairs LPAs: manage your financial matters
- Health and Care LPAs: make decisions about your health and personal welfare
An LPA must be made by a deed, signed by you, detailing the extent of the Attorney’s powers. It should specify who you wish to appoint as your primary and secondary Attorneys (in case the primary Attorney cannot perform the role).
You can appoint the same person for both types of LPA or different individuals for each.
How does an LPA for financial affairs work?
A Financial Affairs LPA grants your Attorney broad powers to manage your finances, such as paying bills, selling and managing property or investments, and handling your bank accounts.
Anyone over 18 can create a Financial Affairs LPA, and anyone over 18 with the mental capacity to act as an Attorney can be appointed, provided they are not bankrupt or subject to a debt relief order at the time of appointment.

The authority to manage financial affairs can be effective immediately or only if you lose mental capacity, as specified in the deed.
What is an LPA for health and care?
A Health and Care LPA allows your Attorney to make decisions about your medical treatment, diet, residence, and daily activities if you lose mental capacity.
Decisions regarding life-sustaining treatment are typically made by medical professionals unless specified in the deed or an End of Life Plan.
