Common Questions About Whistleblowing
What is Whistleblowing?
Whistleblowing occurs when an employee exposes wrongdoing within their workplace. Famous whistleblowers include Frank Serpico, who revealed corruption in the NYPD, and Jeffrey Wigand, who exposed the tobacco industry’s practices. Whistleblowers play a crucial role in preventing and stopping corporate and governmental misconduct.
How Are Whistleblowers Protected?
The Public Interest Disclosure Act 1998 (PIDA) offers two levels of protection for whistleblowers:
- Protection from being dismissed for making a protected disclosure
- Protection from being subjected to detriment for making a protected disclosure
Specific criteria must be met to qualify for protection under PIDA. Our Employment Law Solicitors can quickly determine your eligibility.
What is a ‘Qualifying Disclosure’?
A disclosure qualifies for protection if it is made in the reasonable belief that it is in the public interest and involves one or more of the following wrongdoings:
- A criminal offence has been, is being, or is likely to be committed
- Failure to comply with a legal obligation
- A miscarriage of justice
- Endangerment of health or safety
- Damage to the environment
- Deliberate concealment of any of the above
It is advisable to make disclosures in writing to avoid disputes about what was said. An Employment Tribunal claim may not occur for at least a year after the disclosure, making it difficult to prove without written evidence.
How Much Compensation Will I Get If I Have Been Dismissed for Whistleblowing?
If you win your claim in the Employment Tribunal, there is no cap on the compensation you may receive.
Are There Additional Protections for Whistleblowers in the Financial Sector?
The Prudential Regulation Authority (PRA) and Financial Conduct Authority (FCA) have policies on whistleblowing in large financial institutions. These institutions must appoint a “whistleblowers’ champion” and establish internal whistleblowing channels, informing staff of their rights under PIDA and the roles of the PRA and FCA.
