Why do I need a Will?

What is involved in making a Will?

For the appointment, it is helpful if you bring details of your assets and their approximate value. We will also need information about your chosen executors and beneficiaries.

After the appointment, we will draft the Will and send it to you for approval. Once approved, you will meet with your Solicitor to discuss and sign the Will in the presence of witnesses. Alternatively, the Will can be sent to you with full instructions on how to ensure the signing is carried out correctly.

What are the legal requirements of a Will?

To be legally valid, a Will must be:

  • In writing
  • Signed by the Testator in the presence of two witnesses
  • Signed by the witnesses

Additionally, the Testator must be 18 years or older, have made the Will voluntarily, and be of sound mind.

Can I challenge a Will?

The Courts in England and Wales strongly uphold the principle that a person has the right to leave their estate to whom they wish. Therefore, simply being dissatisfied with a Will is unlikely to result in it being altered in your favour. However, there are valid grounds for contesting a Will, such as believing the Testator was subject to undue influence or fraud, or that they lacked the capacity to understand the document they were creating.
