Solicitor For Speeding Offences

Speeding is one of the most common driving offences.

It’s easy for your speed to increase on motorways or for you to edge over the limit when rushing to get the children to school or arrive at work on time.

In most instances, being caught speeding results in a Fixed Penalty Notice and points on your driving licence. However, if you already have points on your licence, this offence might push you over the 12-point limit within three years, leading to a licence suspension. If you significantly exceed the speed limit or cause injury or death by speeding, you will have to appear in Court. Therefore, if a speeding offence risks your licence or requires a Court appearance, it is crucial to contact our Motoring Solicitors immediately. Our team possesses extensive knowledge of police enforcement technologies, from GATSO cameras to in-car police VASCAR systems. Our unmatched legal and technical expertise will provide the best possible defence if you choose to challenge a speeding allegation.

We are a diverse, multi-lingual law firm operating in Nuneaton, Tamworth, Hinckley, Bedworth, Leicester, Leamington, Derby, and across the Midlands. We use state-of-the-art technology to offer clients efficient, modern, and highly effective motoring law advice and representation. Our years of experience in road traffic and criminal law mean we have strong connections with some of the UK’s top Barristers and King’s Counsel. Our clients also benefit from our ability to engage the country’s most respected expert witnesses who can provide the Court with the facts needed to support a not guilty plea or mitigate the sentence handed down by the Judge.

Common Questions About Speeding

What happens if I am caught speeding?

If you are caught speeding by a fixed speed camera or an in-car police VASCAR system, you will receive a Notice of Intended Prosecution by post. You must respond within 28 days, stating who was driving the vehicle at the time. You may then be offered a speed awareness course or issued a Fixed Penalty Notice of three to six penalty points and a minimum £100 fine.

It is crucial to never provide false information about who was driving at the time of the offence, as charges for perverting the course of justice are common and often result in imprisonment.

How many penalty points will I receive for speeding?

The table below outlines common speeding offences and the potential penalty points:

  • Exceeding goods vehicle speed limits: 3 – 6 points, 4 years on record
  • Exceeding speed limit for the type of vehicle (excluding goods or passenger vehicles): 3 – 6 points, 4 years on record
  • Exceeding statutory speed limit on a public road: 3 – 6 points, 4 years on record
  • Exceeding passenger vehicle speed limit: 3 – 6 points, 4 years on record
  • Exceeding speed limit on a motorway: 3 -6 points, 4 years on record

Can I challenge a speeding allegation?

While you cannot contest a speeding ticket on the basis of not realising you were speeding, there are valid defences, such as:

  • You were not the driver of the car
  • The speed limit sign was missing
  • The speed limit sign was incorrect or not visible
  • Your car was stolen

Our Road Traffic Offences Solicitors can also argue for the Court not to impose penalty points for special reasons. This is applicable if the points from the Fixed Penalty Notice would lead to more than 12 points over three years, resulting in disqualification. Although special reasons do not constitute a legal defence, they provide a reasonable explanation for why the offence occurred, justifying the Court not imposing the usual penalties. For instance, speeding because your pregnant partner needed to reach the hospital quickly to avoid delivering on the roadside.

If no special reasons exist and you risk losing your licence, our Solicitors can argue that disqualification may cause ‘exceptional hardship’, significantly impacting your livelihood and/or family well-being.
