Common Questions About Workplace Discrimination
What is workplace discrimination?
The Equality Act 2010 governs discrimination law. Discrimination occurs when someone is treated differently because they possess or are associated with someone who possesses a particular characteristic. The Act specifies nine protected characteristics:
- Age
- Disability
- Gender reassignment
- Marriage and civil partnership
- Pregnancy and maternity
- Race
- Religion or belief
- Sex
- Sexual orientation
It is illegal for an employer to discriminate against you based on any of these characteristics.
What are the types of discrimination under the Equality Act 2010?
The Equality Act 2010 outlines five types of discrimination:
- Direct discrimination
- Indirect discrimination
- Harassment
- Victimisation
- Instructing, causing, inducing, and helping discrimination
Indirect discrimination is a common basis for Employment Tribunal claims. For instance, scheduling meetings only between 8-9 am or 2.30-4 pm could be seen as indirectly discriminatory against women who need to drop off and pick up children from school.
Can I claim for sexual harassment?
Sexual harassment at work is taken much more seriously due to the #MeToo movement, which has empowered more victims to speak out.
The Equality Act 2010 defines sexual harassment as unwanted conduct of a sexual nature that has the purpose or effect of violating a person’s dignity or creating an intimidating, hostile, degrading, humiliating, or offensive environment.
It doesn’t matter if you had a consensual relationship with the person harassing you or if the harasser is of the same or different sex. Our Employment Law Solicitors handle many sexual harassment claims and understand the difficulty in discussing such experiences. Your confidentiality is assured unless disclosure is necessary to prove your claim, and you will always be in control of what is shared. We will explain every step of the claims process so you know what to expect.
What if my sexual harasser says their conduct was simply ‘banter’?
The Employment Tribunal will assess the workplace culture to determine if behaviour crosses the line from banter to harassment. For example, in Smith v Renrod Ltd ET/1400166/15, despite a culture of sexual banter, the Tribunal found the manager’s actions exceeded acceptable conduct.
