How Do I Get Divorced in England and Wales?

The Divorce, Dissolution, and Separation Act (DDSA) 2020, which took effect on April 6, 2022, ended fault-based divorce in England and Wales. Now, one or both spouses simply need to state that the relationship has irretrievably broken down, and the court must accept this without allowing the other party to contest the divorce.

The terms Decree Nisi and Decree Absolute have been simplified to Conditional Order and Final Order, respectively.

Under the DDSA 2020, there is a minimum period of 20 weeks between the start of the divorce process and the granting of a Conditional Order to allow parties to reflect on whether divorce is the best option for their future.

Will I Lose My Home in a Divorce?

Your family home and other matrimonial assets will be part of the financial settlement. If a pre or post-nuptial agreement exists, we will assess its fairness given your current circumstances.

There are many ways to divide the value of the family home. For instance, one spouse might keep the home while the other retains the value of any pensions built up during the marriage. Alternatively, if you have children, one spouse might stay in the home until the youngest child finishes their education or turns 18.

What Happens to Children in a Divorce?

Both the Family Court and our Solicitors work under the principle set out in the Children Act 1989, which prioritises the welfare of children in family law matters. We will help you and your spouse/civil partner work out child arrangements that ensure your children’s best interests are met.

In cases of domestic abuse, we will secure Non-Molestation Orders or Occupation Orders to ensure the safety of you and your children.

Can I Choose to Divorce in England and Wales?

London is known as the divorce capital of the world due to the English judiciary’s generosity towards the financially weaker party in high-net-worth divorce cases.

To file for divorce in England and Wales, you or your spouse must have adequate ties to either country. You do not need to live there permanently.

To qualify to file for divorce in England and Wales:

  • Either party must be habitually resident in England and Wales.
  • Both parties were last habitually resident in England and Wales, and one continues to live there.
  • The Respondent is habitually resident in England and Wales.
  • The Applicant is habitually resident in England and Wales and has lived there for at least one year immediately before the application.
  • The Applicant is domiciled and habitually resident in England and Wales and has lived there for at least six months immediately before the application.
  • Either party is domiciled in England and Wales.
  • One of you is domiciled in England and Wales.
